The petitioner seeks bail in connection with Naurangiya P.S. Case No. 36 of 2018 dated 20.05.2018 which was initially instituted for the offences under Sections 364A, 34 and 120B of the Indian Penal Code but later charge sheet was submitted only under Section 365 of the IPC.

The petitioner is said to have been caught while trying to abduct the brother of the informant viz. Shiva Tiwary. The aforesaid Shiva Tiwary has not made any statement before the police nor the petitioner has been put on Test Identification Parade.

The petitioner is in custody since 21.05.2018. The cases which have been listed in paragraph-3 of the

Patna High Court CR. MISC. No.34713 of 2019(4) dt.06-09-2019 2/2 petition are all of old antiquity and in all such cases, the petitioner is on bail.

Considering the aforestated facts, the petitioner above named is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IInd, Bagaha, West Champaran in connection with Naurangiya P.S. Case No. 36 of 2018.
