In the present case the petitioner is seeking bail in connection with Chapra P.S. Case No.71 of 2013 registered for the offences punishable under Sections 302 and 109/34 of the Indian Penal Code.

The petitioner had earlier moved this Court in Cr. Misc. Nos. 44209/2013 and 21909/2014 and this Court vide orders dated 22.10.2013 and 22.10.2014 rejected the bail of the petitioner as it has been found that he is a person who caught hold the deceased and other person punctured the belly of the victim and ultimately he died.

This Court has called for the status report of the case.

Patna High Court Cr.Misc. No.42220 of 2015 (3) dt.14-10-2015 From perusal of the said report, it appears that the case has been only committed to the Court of Session and no further steps have been taken.

Looking to the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected. However, the Court below is directed to expedite the trial and conclude the same within a period of one year. If the trial is not concluded within the said period, the petitioner would be at liberty to renew his prayer for bail.
