Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant, namely, Anil Kumar Singh.

The petitioner seeks regular bail in connection with Jehanabad Mahila P.S. Case No. 46 of 2021 lodged under Sections 341, 323, 307, 498(A) of the I.P.C. but the cognizance has been taken for the offences under Sections 341, 323 and 498(A)/34 of the I.P.C. read with Section 3⁄4 of the D.P. Act. As per the prosecution case, at the very outset, both counsel for the petitioner and informant jointly prayed that petitioner and informant having one child and they want to live together peacefully.

No.36960 of 2022(3) dt.20-10-2022 2/2 Learned counsel for the informant only submits that he need an undertaking that her husband shall behave well with the informant and his son like gentlemen, otherwise she has no grievance. The counsel for the petitioner submits that he has already filed undertaking in his bail application that he is ready to live with her wife peacefully.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Jehanabad in connection with Jehanabad Mahila P.S. Case No. 46 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. alongwith a condition that petitioner shall file an affidavit that he shall keep his wife with respect and dignity. With this observation, the bail application stands allowed.
