2. The present criminal miscellaneous application has been filed under Sections 483 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of regular bail to the petitioner who is in custody in connection with Bathnaha P.S. Case No. 189 of 2024, lodged on 06/05/2024, under Section 392 of the IPC.
3. As per the prosecution, allegation of robbery is there in the FIR against three unknown accused persons.
4. Learned Counsel for the petitioner submits that the name of the petitioner has figured in this case by virtue of confessional statement. Counsel submits that the criminal

No.35127 of 2026(3) dt.21-07-2026 2/3 antecedent of the petitioner is not clean as there are eight criminal cases pending against him and out of eight cases he is on bail in five cases. Counsel submits that the petitioner was not put on TIP nor any incriminating article has been recovered from his possession. He submits that the person on whose disclosure he is in custody has been granted bail by the Coordinate Bench of this Court in Cr. Misc. No.74812 of 2024 passed on 22/10/2024. Counsel further submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.
5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that the bail to the said petitioner has been granted on the ground that his antecedent was clean but petitioner has eight criminal antecedent.
6. Considering the fact that the person on whose disclosure name of the petitioner has figured has been granted bail, let the petitioner, above named, be released on bail but only with a condition that he is not absconding in any of the pending cases mentioned below, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi, in connection with Bathnaha,
Patna High Court CR. MISC. No.35127 of 2026(3) dt.21-07-2026 3/3 P.S. Case No. 189 of 2024, subject to the conditions as laid down U/s 480(3) of the BNSS, 2023.
