This is an application for anticipatory bail for the offences under Sections 47(A)(D)(E)(F), 51, 52 and 54 of Bihar Excise (Amended) Act, 2016.
The allegation against the petitioner is that from inside the room of the petitioner, six bags containing 600 bottles of foreign liquor have been recovered.
It has been submitted on behalf of the petitioner that the recovery is not from the house of the petitioner. It has also been submitted on behalf of the petitioner that there is a delay of one day in lodging the F.I.R.
Heard learned APP appearing for the State who opposed
Patna High Court Cr.Misc. No.45353 of 2016 (2) dt.15-12-2016 the prayer for anticipatory bail.
Having heard both sides and in view of the facts stated above, to my mind, this is not a fit case for grant of anticipatory bail. Accordingly, prayer of the petitioner is rejected. However, the petitioner is directed to surrender before the court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
