JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 09-12-2019 Heard learned counsel for the petitioner and the learned counsel for the respondents.
The petitioner, through the instant petition has prayed for the following relief:
"To constitute a high level committee to make proper enquiry with respect to availability of Pharmacists in different Govt. Medical institutions as well s non Govt. Institution and Medical Shops
Patna High Court CWJC No.1942 of 2018(11) dt.09-12-2019 2/3 under the State of Bihar, as several medical Govt. Institutions are running without Pharmacist whereas the Pharmacist play a vital role in health care system through the medicine and information they provide, the quality of medicine supplied to the patient, ensuring supply of medicine is within law and the medicines prescribed to the patients are suitable, make aware the patient regarding taking medicine etc. and also for a direction to the respondent authorities to take appropriate steps to ensure that the patient must receive medicine through safe hand like Diploma Pharmacists as provided under Pharmacy Act, 1948."
The issue pertains to recruitment and appointment of Pharmacist in various establishments within the State of Bihar. After the matter was heard for some time, learned counsel seeks permission to withdraw the present petition reserving liberty to first approach the respondents by way of a representation, which the petitioner intends to make within within a period of four weeks.
Learned A.G. states that without prejudice to the respective rights and contentions of the parties, such representation, if so made, shall be considered and decided in accordance with law within a period of three months from the date of receipt thereof.
Patna High Court CWJC No.1942 of 2018(11) dt.09-12-2019 3/3 Liberty is reserved to the petitioner to approach the Court, if the need so arises.
The petition stands disposed of with the liberty aforesaid.
