JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 13-10-2023 Heard Mr. Sunil Kumar Karn, learned counsel appearing on behalf of the petitioner; Mr. Sanjay Prasad learned AC to AAG 4 for the State and Mrs. Nivedita Nirvikar learned senior counsel for the Accountant General, Bihar.

Learned counsel appearing on behalf of petitioners submits that petitioners seek to file a detailed representation for redressal of their grievance before the Engineer-in-Chief, Irrigation Department, Government of Bihar, Patna in light of order passed by a Division Bench of this Court in LPA No.198 of 2016 (The Registrar General, Patna High Court Versus Ram Vyas Dubey & Ors.) as well as the decision rendered by the Apex Court in the case of Maheshwar Pandey Vs. State of Bihar and Ors. reported in [2023 SCC Online SC 527].
3. Considering the aforesaid specific submission made on behalf of petitioners, Engineer-in-Chief, Irrigation Department, Government of Bihar, Patna is directed to consider the representation/s of the petitioners of the present writ petition and call for their service particulars from the date they were engaged as daily wagers and take final decision in light of the
4/4 decisions rendered in The Registrar General, Patna High Court (Supra) and Maheshwar Pandey (Supra) within a period of three months from the date of filing of such representation/s by the petitioners.
4. With aforesaid observation and direction, the writ petition is disposed of.
