Heard learned counsel for the petitioner and learned A.P.P for the State.
The petitioner has preferred this application for grant of regular bail in connection with Parsa P.S. Case No. 67 of 2023 dated 15.03.2023 registered for the offences punishable u/s 392 of the Indian Penal Code.
As per the prosecution case, four unknown miscreants boarded on motorcycle looted Rs. 1,64,006/- from the staff of the Bharat Finance Branch, Parsa on the point of pistol. Learned counsel for the petitioner has submitted that
Patna High Court CR. MISC. No.36421 of 2023(2) dt.07-07-2023 2/2 the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has surfaced in this case during the course of the investigation. No incriminating material has been recovered from the conscious possession of the petitioner. The said amount was recovered from the possession of the co-accused Kundan Kumar. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 17.03.2023. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Chapra, Saran in connection with Parsa P.S. Case No. 67 of 2023.
The application stands allowed.
