The petitioner seeks bail in a case under Sections 395, 397of the Indian Penal Code.
The petitioner is not named in the F.I.R. During the course of investigation, the investigating officer got information that a gang of criminals including the petitioner is active in the locality; on the basis of which, the petitioner was apprehended and he is alleged to have confessed his guilt. Save and except the hearsay material and the confessional statement of the petitioner, the investigating officer did not collect any further material against the petitioner.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond
Patna High Court Cr.Misc. No.42369 of 2015 (2) dt.16-09-2015 2/2 of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Shikarpur P.S. Case No. 399 of 2014.
