Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 74, 303(2), 352 of the Bharatiya Nyaya Sanhita. 3.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on her purchased land on 26-1-2025 at 3 pm, 7

Mehandi gave orders to assault, thereafter Md. Istekar dashed the informant on the ground and assaulted by fist, on alarm her husband came when Shafiullah, Md. Shivgatullah caught her husband, while Md. Istekhar and Md. Julfikar assaulted him by farsa and sword causing injury on head and he fell, when other accused started assaulting by lathi and iron rod, further the informant raised alarm when Md. Ezaz put cloth in her mouth and the accused also assaulted her son (Kayum) by lathi and rod and the injured were taken to the hospital.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that specific allegation of assault is alleged against Md. Istekhar and Md. Julfikar, who are not petitioners in the present anticipatory bail application. It is further submitted that allegation of assault, as far as petitioners are concerned, is general and omnibus in nature. It is also submitted that husband of the informant suffered grievous injuries but then reiterates that allegation of assault is against the named accused persons as recorded hereinabove. It is next

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners and taking into consideration the fact that petitioners are persons with clean antecedents and there is no specific allegation of assault alleged against the petitioners, the petitioners above-named, in the event of their arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Narpatganj P.S. Case No. 7 of 2026 subject to the conditions as laid down under Section 482 (2) of the BNSS.
