JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-06-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends his arrest in connection with Dalsingsarai P.S. Case No.212 of 2020 registered under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code, pending in the court of the Additional Chief Judicial Magistrate-I, Dalsingsarai, Samastipur.

The accusation is that the petitioner being the clerk in the State Bank of India, Dalsingsarai Branch, withdrew Rs.2,82,000/- from the House Loan Account No.11459331531 of Manikant Chaudhary in between 06.07.2019 to 17.09.2019 and also transferred the Fixed Deposit Amount of Dewan Jha, who died on 19.11.2010, in different accounts.

No.34756 of 2020(3) dt.25-06-2021 2/2 Learned counsel appearing on behalf of the petitioner submits that it has come in the F.I.R. and also in the statement of the Chief Manager, State Bank of India, Dalsingsarai Branch, that withdrawn amount of Rs.18,41,800/- has already been recovered.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
