According to the prosecution case itself, the alleged occurrence took place in the night of 14.07.2013 and the first information report was lodged on 19.07.2013. The Explanation regarding the aforesaid delay has been given by the informant in the written report stating that when her husband returned home, she lodged the present case.

The contention on behalf of the petitioner is that petitioner and informant are agnates and as a matter of fact, due to previous dispute the present case was lodged. Moreover, petitioner is in jail custody since 16.6.2015 and the investigation has already

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with G.R.No. 2206 of 2013 arising out or Riga P.S.Case No. 136 of 2013.
