2. At the very outset, learned counsel appearing on behalf of the State submits that an alternative statutory remedy is available to the petitioner to move before the Special Secretary, Education Department, Government of Bihar, by way of filing appropriate application under Section 24 of the Act.

3. As the petitioner has got statutory alternative

Patna High Court CWJC No.9846 of 2022(3) dt.16-01-2025 2/2 remedy to move before the Special Secretary, Education Department, Government of Bihar, under Section 24 of Act, this Court is not inclined to interfere in the matter in its extraordinary writ jurisdiction.

4. In view of the aforesaid facts and circumstances, petitioner is granted liberty to file an application before the Special Secretary, Education Department, Government of Bihar, within one month.

5. In the event, such an application is filed by the petitioner, the Special Secretary, Education Department, Government of Bihar, is directed to dispose of the same, in accordance with law, after hearing the parties, by a reasoned and speaking order within six weeks thereafter.

6. With the aforesaid observations and directions, this writ application stands disposed of.
