2. It transpires to this Court that vide order dated 09.01.2024, when none had entered appearance on behalf of the petitioner, as a matter of last indulgence, the matter was adjourned for two weeks.

3. Learned counsel for the State submits that the

Patna High Court CWJC No.4920 of 2018(7) dt.23-01-2024 2/2 present writ petition has been filed for directing the respondent to conclude the enquiry. This writ petition was filed in the year 2018. He further submits that by way of filing a counter affidavit dated 23.11.2023, it has been intimated to this Court that disciplinary proceeding has been concluded in the year 2021 and appellate order has also been concluded in the year 2022 which are Annexure R2/4 and Annexure R2/5 of the 2nd supplementary counter affidavit. He further submits that this case has now become infructuous and only due to this reason, the petitioner is not appearing in this matter.

4. In the aforesaid facts and circumstances, the present writ petition stands dismissed due to non-prosecution. (Dr. Anshuman, J) Ashwini/- U
