Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioners seek bail in connection with Barbigha P.S. Case No. 122 of 2021 registered for the offence under Section 395 of the Indian Penal Code and added Section 412 of the Indian Penal Code.

As per the prosecution case, the petitioners are accused of committing dacoity and their name has transpired during investigation. They are accused in 6 more cases of similar nature.

Patna High Court CR. MISC. No.43726 of 2023(2) dt.04-08-2023 2/2 In view of the aforesaid fact, this Court is not inclined to grant bail to the petitioners even if similarly situated co-accused have been granted bail.

Accordingly, the prayer of bail of the petitioners are rejected herewith.

The District Judge, Sheikhpura is directed to expedite the trial of following cases:- (i) Sarmera P.S. Case No. 111 of 21.

(ii) Rahui (Bhagan Bigha) P.S. Case No. 209 of 2021.

(iii) Rahui (Bhagan Bigha) P.S. Case No. 207 of 2021.

(iv) Noorsarai P.S. Case No. 143 of 2021.

(v) Nalanda P.S. Case No. 31 of 2021.

(vi) Noorsarai P.S. Case No. 169 of 2021.

Let a copy of this order be communicated to the District Judge, Sheikhpura and the District Judge, Nalanda, for its forthwith compliance.
