JUSTICE SUDHIR SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code and Section 3(2) (v) of the Scheduled Castes and Scheduled Tribes (prevention of Atrocities) Act.

As per prosecution case, brother of the informant went to watch match in the field at 5 P.M. but thereafter he did not return. Next day, as per information, informant found her brother's dead body in the field and raised suspicion that he was killed by unknown person.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 31.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. There is no eye witness to the alleged occurrence. Merely on the basis of suspicion the petitioner has been made accused in the present case.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case no. 353 of 2014.
