JUSTICE SATYAVRAT VERMA ORAL ORDER 10-12-2021 The present petition has been taken up for consideration through the mode of Video Conferencing in view of the prevailing situation on account of Covid 19 pandemic, requiring social distancing.

Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Excise Case No. 147 of 2021 dated 19.04.2021 registered under Sections 30 (a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioners submits that the petitioners are in custody since 19.04.2021, and are persons of

Patna High Court CR. MISC. No.45353 of 2021(2) dt.10-12-2021 2/2 clean antecedent and charge-sheet has been submitted. Allegation is of recovery of 1080 litres of foreign liquor from a Tata 407 vehicle as detailed in the F.I.R. during vehicle checking. Learned counsel further submits that the petitioners are the driver and Khalasi of the aforesaid vehicle and was not aware what was transported in the vehicle.

Learned APP for the State opposes the prayer of regular bail application of the petitioners.

Considering the fact that the petitioners are in custody since 19.04.2021, charge-sheet has been submitted in this case and the petitioners, are persons with clean antecedent, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- Iind cum Special Judge, Excise Act, Gaya in connection with Excise Case No. 147 of 2021.
