2. The petitioner is apprehending his arrest in connection with Katihar (Nagar Sahayak) P.S. Case No. 449 of 2024, F.I.R. dated 28.06.2024 for the offences punishable under Sections 376, 306, 323/34 of the Indian Penal Code.

According to prosecution case, the informant alleged that her daughter, namely, Sonali Kumari (now,deceased) was in love affair with the petitioner and on pretext of marriage, the petitioner established physical relation with her daughter and when she became pregnant, the petitioner refused to marry her, on account of which, the victim committed

Patna High Court CR. MISC. No.35726 of 2025(2) dt.16-06-2025 2/2 suicide on 08.05.2024.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.

5. The learned Additional Public Prosecutor on the basis of materials available on record and case diary has vehemently opposed the prayer for bail of the petitioner and submits that the petitioner established physical relation with the victim due to which she became pregnant and later on, the petitioner refused to marry her, on account of which she committed suicide.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Katihar (Nagar Sahayak) P.S. Case No. 449 of 2024, pending in the court of C.J.M. Katihar.

7. Prayer is refused.
