The petitioners seek bail in Shahpur Patori (Mohanpur OP) P.S. Case No. 124 of 2021, registered for the offence punishable under Sections 363, 366, 366A, 34 of the Indian Penal Code.
As per the prosecution case, three FIR named accused persons kidnapped the minor daughter of informant for unlawful purpose.
It is submitted on behalf of the petitioner that petitioners are not named in the FIR. During course of investigation, name of this petitioner has come in this case in restatement of informant. The victim girl in her statement under
Patna High Court CR. MISC. No.46456 of 2021(2) dt.16-11-2021 2/2 Section 164 has not stated anything about these petitioners. Petitioners are in custody since 25.04.2021. Investigation is complete.
In view of statement of victim girl under Section 164 Cr.P.C, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cumSpecial Court (POCSO), Samastipuir in connection with Shahpur Patori (Mohanpur OP) P.S.
