The petitioner seeks bail in Kanti P.S. Case no. 76/2015, registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The case relates to a highway dacoity of a truck. The petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement. The petitioner is also said to have confessed his guilt but save and except the confession, the police did not collect any further tangible material. Similarly situated co-accused Birchandra Kumar Yadav and Manoj Ram have already been enlarged on bail. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.41308 of 2015 (2) dt.10-09-2015 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge, Muzaffarpur, in connection with Kanti P.S. Case no. 76/2015.
