JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-01-2021 Heard learned counsel for the petitioner and Mr. Chandrasen Prasad Singh, learned APP for the State. The petitioner in the present case is seeking regular bail in connection with Excise Case No. 612 of 2020 registered for the offence punishable under Section 30(a) of the Excise Act. Learned counsel for the petitioner submits that the informant got secret information that in a house which is in dilapidated condition and is in occupation of Uma Singh @ Sanjay Kumar illicit liqour is being sold. The informant raided the house and recovered 37.5 liters of illicit liquor.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the house from which illicit liquor has been recovered does not belong to the petitioner. The petitioner is in judicial custody since 20.07.2020.
Patna High Court CR. MISC. No.34109 of 2020(3) dt.29-01-2021 2/2 Learned APP for the State has opposed the prayer for regular bail of the petitioner.
Having regard to the facts and circumstances of the case, wherein the recovery is said to have been made from the house of the petitioner and he has three criminal antecedents of similar nature and as it appears the petitioner is getting involved in similar offence while he is on bail, this Court is not inclined to grant privilege of regular bail to the petitioner at this stage. The prayer for regular bail of the petitioner is, thus, refused.
The petitioner may renew his prayer for regular bail after a reasonable period.
The application stands disposed of.
