JUSTICE PRAVEEN KUMAR ORAL ORDER 21-05-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State as well as learned counsel for the informant through video conferencing.
2. This application for anticipatory bail arises out of Shyampur Bhathan P.S. Case No. 62 of 2026 registered for the offence punishable under Sections 126(2), 115(2), 85, 80, 238, 3(5) of B.N.S.
3. As per the allegation, the niece of the informant was done to death for non-fulfillment of dowry by the petitioner and other co-accused persons.
4. Learned counsel for the petitioner has submitted that petitioner is married sister-in-law (Nanad) and there is general and ominous allegation against her and she used to reside in her matrimonial house after being married ten years
Patna High Court CR. MISC. No.35135 of 2026(2) dt.21-05-2026 2/2 ago. It has further been submitted that the husband of the deceased is in judicial custody and statement to this effect has been made in Para-15 of the anticipatory bail application. It has further been submitted that there is no material to show that there was any demand of dowry soon before death and alleged torture for the same.
5. Learned counsel for the State has vehemently opposed the prayer of anticipatory bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the entire facts and circumstances of case including the fact that the husband of deceased is in judicial custody, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Sheohar, in connection with Shyampur Bhathan P.S. Case No. 62 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
