Petitioner is in custody in connection with Special Case No.05 of 2019 arising out of Maheshi P.S.Case No.39 of 2019 pending in the Court of Special Judge, NDPS-cumSessions Judge, Saharsa registered for an offence under Sections 20 and 22 of the NDPS Act.

As per prosecution case, the allegation against this petitioner is that during course of checking of the vehicle by the circle officer on secret information about smuggling of ganja, weighing 7.100 K.G. of ganja was recovered from his possession.

In view of the nature of allegation and the fact that 7.100 K.G. has been recovered from the possession of the petitioner, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected. However, the trial court is directed to expedite the trial and conclude the same within a period of one year from the
