JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-09-2015 Heard learned counsel for the petitioner and learned counsel for the complainant as well as learned Additional Public Prosecutor for the State.
Petitioner being husband of the complainant is in jail custody since 19.07.2015 in a case in which cognizance has been taken for the offence punishable under section 498A of the Indian Penal Code.
It would appear that earlier petitioner was granted privilege of anticipatory bail by this Court directing the petitioner to take the victim to his home and in pursuant to the above stated direction, petitioner took victim to his home but again dispute
Patna High Court Cr.Misc. No.41397 of 2015 (2) dt.14-09-2015 2/2 arose between the parties resulting the arrest of the petitioner in the present case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Kaimur at Bhabua in connection with Complaint Case No.1369 of 2012 corresponding to Trial No. 4399 of 2015.
