JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in connection with Buxar (Muffasil) P.S. Case No. 387 of 2018 for the offenses under Sections 399,402,414 IPC and 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner and only on account of disclosure of name of the petitioner and others, the petitioner has been made accused in this case. Similarly circumstanced co-accused has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 4729of 2020.
Considering the aforesaid, the court is inclined to
Patna High Court CR. MISC. No.28483 of 2020(2) dt.19-01-2021 2/2 grant bail to the petitioner on deposit of Rs. 25,000/- cash. Let the petitioner, above named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Buxar in connection with Buxar (Muffasil) P.S. Case No. 387 of 2018, subject to deposit of Rs. 25,000/- cash and further subject to the conditions laid down under Section 438(2) Cr.P.C.
The deposit of cash of Rs. 25,000/- shall abide by the final outcome of the present criminal case.
