2. This application for anticipatory bail arises out of Shyampur Bhathan P.S. Case No. 62 of 2026, registered for the offence punishable under Sections 126(2), 115(2), 85, 80, 238 and 3(5) B.N.S.

3. As per the allegation, the petitioners, who respectively are the brother-in-laws (jeth and Devars) of the husband of the deceased, along with co-accused persons, had killed the niece of the informant for non-fulfillment of dowry demand and with a view to conceal the evidence by cremating

Learned counsel for the petitioners has submitted that the petitioners happen to be the brother-in-laws (jeth and Devars) of the husband of the deceased and they reside separate in mess and residence and have got no concern with the deceased or her husband. It has further been submitted, referring to paragraph 15 of the anticipatory bail application, that the husband of the deceased is in judicial custody. It has further been submitted, referring to the impugned order, that since the post mortem report is not there on the record, the cause of death the deceased could not be ascertained. It has further been submitted that there is general and omnibus allegation against the petitioners. It has lastly been submitted that except petitioner No.1, against whom one another criminal case was lodged, in which he is on bail, the other petitioners have got no criminal antecedent.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioners.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances, let the petitioners above named, in the event of their arrest/surrender

Patna High Court CR. MISC. No.35179 of 2026(2) dt.21-05-2026 3/3 within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M. 1, Sheohar, in connection with Shyampur Bhathan P.S. Case No. 62 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
