Petitioner is apprehending his arrest in connection with Singhiya P.S.Case No.115 of 2018 , registered for offences punishable under Sections 302, 120(B) of the Indian Penal Code.

Prosecution case is that the son of the informant has been killed by the petitioner and other accused persons under a conspiracy by calling him.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case only on suspicion and the postmortem report does not disclose any external and internal injury on the person of the deceased and the viscera report was called for. Perused the viscera report

Patna High Court CR. MISC. No.34367 of 2019(4) dt.05-09-2019 2/2 that discloses that no metallic, alkaloidal, glycosidal, pesticidal or volatile poison cold be detected.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge 2nd, Rosera, District Samastipur in connection with Singhiya P.S.case No.115 of 2018, vide S.T.No.17 of 2019, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition to cooperate in the investigation.
