JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This is an application for grant of anticipatory bail in connection with Risiup P. S. Case No. 76 of 2018, disclosing offences under Sections 302, 201, 34 of IPC.
Prosecution case is that son of the informant was killed by unknown persons by throwing him and blood was oozing from his head. The informant suspects the hand of the petitioner along with other accused persons.
Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case on the basis of suspicion. During the investigation, only suspicion was found against the petitioner.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail of the petitioner and has also submitted that nothing has been asserted in the investigation and there is

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Aurangabad, in connection with Risiup P. S. Case No. 76 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that petitioner has to co-operate in the investigation.
