2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 506, 342, 323 , 324 , 307 and 34 of the Indian Penal Code.

3. On the alleged date and time of occurrence when the informant was at the reception party , meanwhile all the FIR named accused persons including this petitioner came there and dragged him towards Scorpio vehicle and assaulted him with lathi, causing injury to him.

4. It is submitted that the petitioner is quite innocent and has not committed any offense as alleged against him, and the instant case is only a counterblast of Shikarpur P.S. FIR No.

Patna High Court CR. MISC. No.36389 of 2023(4) dt.21-09-2023 2/2 365 of 2022, which was lodged by the petitioner, Sheikh Saddam, against the informant, and in which the petitioner has also sustained injuries. There is a general and omnibus allegation of assault against this petitioner, and the injury sustained by the injured is simple in nature. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , West Champaran at Bettiah in connection with Shikarpur P.S. case No. 364 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
