2. The petitioner has preferred this application for grant of regular bail in connection with Harsiddhi P.S. Case No. 168 of 2026 registered for the offences punishable under Sections 109, 125, 351(3) of the B.N.S., 2023 and Section 27 of the Arms Act.

3. As per the prosecution case, the informant happens to be a businessman and he was attacked earlier by miscreants for which an FIR bearing Harsiddhi P.S. Case No. 184 of 2025 was registered against the petitioner. It has further been alleged

No.35141 of 2026(3) dt.17-07-2026 2/3 that the informant was being pressurized to compromise the case and consequently thereupon on 19.03.2026, four to five unknown miscreants came on motor cycle and started firing at the door of the informant. It has further been alleged that he was threatened with dire consequences, if the compromise is not affected.

4. Learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that there is delay of three days in lodging the present FIR and admittedly petitioner was not present at the place of occurrence when the alleged occurrence took place. It has further been submitted that no one was injured in the alleged occurrence. It has further been submitted that the only allegation against the petitioner is that he was suspected to be the conspirator of the present alleged occurrence. It has further been submitted that there is no material on record to show that the petitioner ever threatened the informant or the other witnesses of Harsiddhi P.S. Case No. 184 of 2025. It has further been submitted that petitioner was accused in one another case in which he is on bail. Lastly, it has been submitted that the petitioner is in custody since 30.03.2026 and charge sheet has been submitted in the present case and

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner. It has further been submitted by learned counsel for the informant that the petitioner was also accused in Harsiddhi P.S. Case No. 184 of 2025 and the informant has rightly suspected that the petitioner was the conspirator in the present case.

6. Heard the parties and perused the record.

Considering the facts and circumstances as well as nature of material against the petitioner, let the petitioner abovenamed, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, East Champaran at Motihari in connection with Harsiddhi P.S. Case No. 168 of 2026.
