Petitioners apprehend arrest in a case registered for the offence punishable under Sections 307/34 and 302 of the IPC and section 27 of the Arms act.

As per the prosecution case, while the father of informant was sleeping at his poultry farm, six named accused persons including petitioners variously armed came there and asked from informant's father about whereabout of the informant. It is further alleged that petitioner no. 2 fired upon the father of informant, as a result of which he died. Learned counsel appearing for the petitioners submits

Patna High Court CR. MISC. No.36341 of 2022(2) dt.07-11-2022 2/2 that the petitioners are innocent and have falsely been implicated in this case. It is submitted that there is no eyewitness of the occurrence. police after investigation found the petitioners innocent and submitted final report, but the learned court below differing with the same took cognizance against them. Petitioners have got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-13 Saran at Chhapra in connection with Manjhi P.S. Case no. 439 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
