2. The petitioner seeks bail in a case registered for offence under Sections 341, 323, 307, 379, 302, 34 of the Indian Penal Code.

3. As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including this petitioner assaulted father of the informant by lathi and iron rod, leading to his death.

4. Learned counsel for the petitioner submits that both parties are agnates and there is land dispute between them. As a matter of fact, on the alleged date, measurement of land in Chawar was going on by Amin and all the accused persons were in the Chawar area, in the meantime, informant and his family members came there and started abusing and also disturbing measurement work. The father of the informant, aged about 80

No.39196 of 2024(2) dt.19-07-2024 2/2 years, also came there and co-accused Bittu Singh assaulted him with iron rod, due to which, he fell down and sustained injury on the back side of head and during course of treatment, died. Learned counsel for the petitioner further submits that specific accusation of assault is against co-accused Bittu Singh @ Manoranjan Singh and so far as this petitioner is concerned, there is general and omnibus allegation of assault against him. He next submits that in the post-mortem report, the deceased has sustained one injury on his head which is attributed to coaccused Bittu Singh @ Manoranjan Singh. Petitioner is in custody since 22.03.2024.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonpur P.S. Case No. 1227 of 2023.
