JUSTICE RAKESH KUMAR ORAL ORDER 24-11-2016 Heard Sri Pankaj Kumar Sinha, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner apprehending his arrest in Chandradeep P.S. Case No. 70 of 2016 registered for the offence under section 273 of the Indian Penal Code , Section 47(A) of the Bihar Excise Act has prayed for grant of anticipatory bail . By way of referring to the F.I.R. learned counsel for the petitioner submits that a false accusation has been made against the petitioner as if petitioner while fleeing away threw a bag containing about 13 liters of Indian make foreign liquor . He submits that nothing was recovered from conscious possession of the petitioner nor from his house.
In view of the facts and circumstances , in the event of
Patna High Court Cr.Misc. No.48188 of 2016 (2) dt.24-11-2016 2/2 arrest or surrender within a period of six weeks from today, let the petitioner Sukhdeo Paswan be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar , Judicial Magistrate 1st Class, Jamui / concerned court in connection with Chandradip P.S. Case No. 70 of 2016 subject to the conditions as contemplated under section 438(2) of the Code of Criminal Procedure.
