The petitioner is languishing in custody for the offence punishable under Sections 8, 20, 25 and 29 of the N.D.P.S. Act.

More than 29 Kg of ganja was allegedly recovered from the house of the petitioner. Petitioner is in custody since 19.08.2019.

The report of the trial Judge dated 04.01.2021 would reveal that only two police personnel are to be examined in the case as prosecution witnesses and rest have already been examined.

The SP, Gopalganj is directed to ensure production of those witnesses in connection with Gopalpur P.S. Case No. 21

Patna High Court CR. MISC. No.33892 of 2020(4) dt.29-01-2021 2/2 of 2019 pending before 1st Additional Sessions Judge, Gopalganj.

The investigating officer has submitted chargesheet awaiting the FSL report, hence the SP, Gopalganj shall ensure that the FSL report is procured and produced before the trial Judge.

The Director, Forensic Science Laboratory, Patna is directed to transmit the aforesaid report at the earliest so that the trial may not hamper.

With the aforesaid observation, prayer for bail of the petitioner is refused for the present in connection with Gopalpur P.S. Case No. 21 of 2019.
