2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 10 litres of illicit country made liquor, 700 litres of raw material and other articles have been recovered from the Basa of petitioner no. 1.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in the present case. Nothing incriminating has been recovered from the conscious possession of the petitioners. From perusal of FIR and seizure

Patna High Court CR. MISC. No.35400 of 2025(2) dt.03-07-2025 2/2 list it is evident that recovery has been made from Basa, which is an open place and is accessible to one and all. Name of petitioners transpired in the present case on the basis of disclosure made the local villagers. Petitioners have no concern with the alleged recovery. Petitioners claim clean antecedent.

5. Learned APP for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the petitioners, above-named, in the event of their arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Special Excise Judge-II, Khagaria, in connection with Beldaur P.S. Case No. 74 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023.
