The petitioner seeks bail in a case registered for the offences punishable under sections 364-A/34 of the Indian Penal Code.

It is alleged by the informant that accused Bawa Singh and Bullu Singh have kidnapped her husband Om Prakash Ram from near a mill and took away on a motor cycle. After some time, a phone came on the mobile of Ganesh Singh and a demand of Rs.20,000/- was made for releasing Om Prakash Ram and threatened that he will be killed if the amount is not paid. It has been submitted on behalf of the petitioner that petitioner is in custody since 05.06.2015. Charge-sheet has

Patna High Court Cr.Misc. No.41574 of 2015 (3) dt.14-10-2015 been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. Petitioner has falsely been implicated in the present case due to mistake of fact. It is further submitted that the petitioner may be released after completion of six months in custody from 05.06.2015.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail after completion of six months in custody from 05.06.2015 on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri S. C. Kumar, Judicial Magistrate, 1st Class, Nawadah in connection with Warisaliganj P.S. Case No. 152 of 2015.
