Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-05-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 341, 323, 324, 307 and 504 of the Indian Penal Code. The prosecution case is that when the informant went to see his field, accused persons armed with deadly weapons arrived there, abused and assaulted the informant and his wife. It is further alleged that they also snatched Rs.3,000/- from the possession of the informant. It is further alleged that during course of occurrence Lalan Yadav assaulted the informant on his head by spade causing head injury.

No.34613 of 2019(2) dt.29-05-2019 2/2 The contention of the petitioners is that both the parties are of same family and there is land dispute due to which they have been falsely implicated in this case. No such injury has been caused by the petitioners nor any injury report has been reported by the I.O. Petitioners are students and are having clean antecedent.
Considering the facts aforesaid, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar/successor Court in connection with Pranpur (Roshna) P.S. Case No. 40 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bonds of the petitioners.
