2. The petitioner apprehends his arrest in a case, registered for offence punishable under Section 108 of the B.N.S., 2023.

As per F.I.R., on 14.03.2025, wife of younger brother of informant namely Bandana Kumari committed suicide in her rented house and left a suicide note alleging that the petitioner has forced her to commit suicide. Further allegation is that husband of deceased used to live abroad for his livelihood. Deceased was also in business and petitioner came in touch with her and on the basis of his good relation, he has taken money from deceased and purchased a plot, when deceased demanded her money, the petitioner showed some intimate photos of the deceased to her and on the basis of that

Informant further alleged that the deceased had told him that the petitioner is not returning her month. Thus, being fed up with blackmailing of the petitioner, deceased committed suicide and made allegation in her suicide note against the petitioner that he is responsible for her suicide.

Learned senior counsel for the petitioner submits that petitioner is quite innocent and has been falsely implicated in this case due to animosity with brother of deceased on purchase of 10 dhurs of land from the deceased. The deceased had got 0.372 decimal land in R.S. Plot No. 2684, under Khata No. 957 at Rasulpur, vide registered sale-deed from her father, for which, her brother was not agreeable and had filed a title suit in the court of learned Sub-Judge - VII, Saran at Chapra. He further submits that since deceased and her husband were in need of money, they contacted with petitioner for sale of land and this petitioner transferred Rs. 28,50,000/- in the account of deceased through Priyanshi Enterprises, Harshit Layer Farm, the firm of petitioner. Thus, deceased and her husband had no grievance with this petitioner and there is no reason of being cause of her committing suicide.

However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in the F.I.R. with specific accusation against him that due to black-mailing by this petitioner, deceased was compelled to commit suicide. During investigation, number of witnesses have supported the prosecution case. Suicide note left by the deceased supports the prosecution case.
6. Considering the nature of accusation, the prayer for anticipatory bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay U T
