JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 302/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner have assaulted husband of the informant as a result of which he died.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 25.5.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against him. No deadly weapon is said to have been used in course of occurrence. General and omnibus allegation has been made against the petitioner and others. No specific injury has been attributed against him. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.42274 of 2015 (3) dt.24-11-2015 2 / 2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan , in connection with Darauli P.S. Case no. 77 of 2015.
