====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-07-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on 06.08.2023 at 8:20 PM, these petitioners came at the shop of the informant and demanded ransom. On protest, these petitioners fired upon brother of the informant and committed theft of items worth Rs. 3 lacs from the shop.

4. Learned counsel for the petitioners submits that both parties are co-villagers and due to dispute over passage, an

Patna High Court CR. MISC. No.40822 of 2024(2) dt.15-07-2024 2/2 altercation took place between them. Injuries caused by these petitioners are simple in nature and allegations of demand of ransom and theft are ornamental only to make the case grave. Petitioners claim clean antecedent.

Considering the backdrop of the case and simple nature of injuries, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Rosera, Samastipur in connection with Larjha Ghat P. S. Case No. 02 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
