The petitioner seeks bail in connection with Mairwa P. S. Case No. 266 of 2020 dated 31.08.2020, instituted for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation in the F.I.R. is of recovery of 601.80 litres of liquor from a vehicle of which the petitioner is said to be the Driver.

The learned counsel for the petitioner has submitted that he has been arrested on mistaken

Patna High Court CR. MISC. No.34540 of 2020(2) dt.22-12-2020 2/2 identity and is a person of clean antecedents. He is in custody since 01.09.2020.

Regard being had to the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge 2nd cum Special Judge, Excise, Siwan, in connection with Mairwa P. S. Case No. 266 of 2020. The petition stands allowed.
