2. The petitioners apprehend their arrest in connection with Katihar (Sahayak) P.S. Case No. 627 of 2023, instituted under Sections 341, 323, 498(A), 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, on the date of occurrence husband of the informant and her brother-in-law assaulted the informant using abusive language. It is alleged that mother-in-law of the informant asked her to bring Rs. 5 lacs from her parental house.
4. Learned counsel for the petitioners submits that Petitioner No. 1 is brother-in-law of the informant and Petitioner No. 2 is mother-in-law of the informant. They have falsely been
Patna High Court CR. MISC. No.40965 of 2024(2) dt.03-07-2024 2/2 implicated in this case. Earlier also two cases had been filed by the informant against the petitioners in which they are on bail. Marriage of the informant with co-accused Kaushal Kumar Singh was solemnized in the year 2010. They are living separately from the petitioners. Petitioners have no concern with the family affairs of the informant and her husband. Petitioners undertake to cooperate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned concerned Court where the case is pending in connection with Katihar (Sahayak) P.S. Case No. 627 of 2023, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure, 1973. (Sunil Dutta Mishra, J) rakhi/- U T
