JUSTICE ASHUTOSH KUMAR ORAL ORDER 12-03-2018 The present revision petition is directed against the judgment and order dated 10.10.2015 passed by the learned 3rd Additional District & Sessions Judge, Araria in Cr. Appeal No. 10/104 of 2014/Supplementary Trial No. 04 of 2014 whereby the opposite party Nos. 2 to 6 have been acquitted of the charges under Section 379/34 of the Indian Penal Code but the conviction under Section 323 of the Indian Penal Code was upheld and the sentence imposed by the Trial Court has been modified by releasing the opposite party Nos. 2 to 6 after admonition, by giving them the benefit of Section 3 of the Probation of Offenders Act, 1958.
Patna High Court CR. REV. No.53 of 2016 (2) dt.12-03-2018 2/2 Perused both the judgments of the Courts below. No good ground has been made out for interference with the judgments passed by both the Courts below. There is no merit in the present petition and is therefore, dismissed.
