The petitioner apprehends his arrest in Garwandanga P.S. Case No.07 of 2020 registered under Sections 323, 341, 324, 325, 307 and 34 of the Indian Penal Code. The informant alleged that Mustkim, Mukim (petitioner), Karsad Alam, Javed Alam and Asahar Alam surrounded his son and assaulted his son Faiyaz Alam with an intention to kill him. On the order of Karsad Alam, Mustkim assaulted his son with sharp-edged weapon on his neck. Learned counsel for the petitioner submits that Faiyaz Alam got two injuries. Both injuries are simple in nature. Mustkim is alleged to have given blow on the neck of the son of the informant with sharp-edged weapon but no sharp cut wound was found on the person of the son of the informant.

No.34950 of 2020(2) dt.17-03-2021 2/2 Taking into consideration the facts that no specific allegation of assault is made against Mukim (petitioner) and only two injuries are found on the person of Faiyaz Alam and both injuries are opined to be simple in nature, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Kishanganj in connection with Garwandanga P.S. Case No.07 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
