JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 This is an application for grant of anticipatory bail in connection with Jamui P. S. Case No. 71 of 2016, disclosing offences under Sections 302, 201, 34 of IPC.

As per F.I.R. the police has received an information that a dead body near the Month Canal of Lakhan Dhanma village was found, which hands were tied from behind. As such, F.I.R. has been registered against unknown. Later on, the name of the petitioner transpires on the confidential information of the villagers.

Submission of the learned counsel for the petitioner is that there is absolutely nothing against the petitioner and there is nothing in the case diary to show as to who disclosed his name. He is ready to abide by any condition imposed on him. Heard learned A.P.P. also, who also could not controvert the above facts.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Jamui, in connection with Jamui P. S. Case No. 71 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to appear before the I.O. and cooperate in the investigation.
