The petitioner is in custody in a case registered under Sections 384/414/34 of the Indian Penal Code and 25(1-b)a,26 and 35 of Arms Act.

The allegation against the petitioner is that from his possession one loaded country made pistol was recovered from his possession.

It has been submnitted on behalf of the petitioner that the petitioner is in custody since 15.4.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. It is alleged that from the possession of the petitioner one loaded country made pistol and

Patna High Court Cr.Misc. No.42146 of 2015 (3) dt.16-10-2015 2/2 one live cartridge were recovered. No compliance of Section 100 Cr.P.C. is said to have been made. The recovery is denied by the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in Kotwali (Barari) P.S.Case No. 227 of 2015.
