The petitioner seeks bail in Powakhali P.S. Case No. 58/2018, instituted for offence under Section(s) 341, 307, 324, 504 and 506/34 of the Indian Penal Code.

It is alleged in the written report that informant got information by the villagers that his cousin Juber Alam has sustained stab injury caused by petitioner. He was taken to hospital.

Learned counsel for the petitioner has submitted that the occurrence has taken place due to land dispute. Case diary has been received.

Learned Addl. P.P. has submitted that statement of injured Juber Alam is recorded in para 32 of case diary, wherein

Patna High Court CR. MISC. No.33711 of 2019(3) dt.18-07-2019 2/2 he has stated that two persons, namely, petitioner and Soyeb Alam caused dagger blow to him causing him injury. Injury report is annexed as Annexure-2, wherein doctor has found one injury caused by sharp object. Petitioner is in custody since 02.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj, in connection with Powakhali P.S. Case No. 58/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
