JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 This case has been listed today under the heading "To Be Mentioned" at the instance of the petitioners. Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. It has been submitted by learned counsel for the petitioners that vide order dated 22.10.2019, the prayer of anticipatory bail of petitioner no. 2 was dismissed, whereas, petitioner nos. 1, 3 and 4 were allowed the privilege of anticipatory bail. However, in the second last paragraph of order dated 22.10.2019, there is only mentioning about petitioner nos. 1 and 3
Patna High Court CR. MISC. No.34093 of 2019(5) dt.12-12-2019 2/2 and there is no mentioning of petitioner no. 4. Having heard the parties and on perusal of the record maintained by the court master, learned counsel for the petitioners appears to be right in his submission. As such, last but one paragraph of order dated 22.10.2019 is modified to the extent that the same be read as follows:- So far petitioner nos. 1 ,3 and 4 are concerned, in the event of his arrest or surrender before the court below be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of like amount each to the satisfaction of the learned CJM, Sitamarhi, in connection withi Runisaidpur P.S. Case No. 122 of 2016 subject to the condition as laid down under Section 438(2) Cr.P.C. All other parts of the order dated 22.10.2019 shall remain intact.
Let a copy of this order be communicated to the concerned court below forthwith.
