2. With the consent of both the parties, this writ application is being disposed of at the present stage itself.
3. Learned counsel for the petitioner submits that for seeking the reliefs as claimed for in the present writ application,
Patna High Court CWJC No.9557 of 2025(2) dt.02-07-2025 2/3 the petitioner has already filed a representation dated 28.11.2024 before the District Magistrate-cum-Collector, Arwal (Respondent No. 5) which has been enclosed in the writ application as P/13, which continues to be pending. Learned counsel for the petitioner submits that the petitioner would be satisfied if an appropriate direction could be issued to the District Magistrate-cum-Collector, Arwal (Respondent No. 5) to dispose of its representation on merit after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order.
4. To this prayer being made by the learned counsel for the petitioner, the learned counsel appearing for the Mines Department and learned counsel for the Respondent-State do not have any objection.

Considering the formal nature of prayer being made by the learned counsel for the petitioner, this writ application is being disposed of directing the District Magistrate-cumCollector, Arwal (Respondent No. 5) to dispose of the representation of the petitioner dated 28.11.2024 (AnnexureP/13 to the writ application) on merit after giving an opportunity of hearing to the petitioner, by passing a reasoned and speaking order.

6. The entire exercise must be carried out within a period of two months from the date of production of a copy of this order by the petitioners.
