The sole petitioner apprehending his arrest in connection with K. Hat (Maranga) P.S. Case No. 729 of 2014 registered for the offence under Section 447, 436, 385, 504/ 34 of the Indian Penal Code has prayed for grant of anticipatory bail. It was submitted by learned counsel for the petitioner that there was admittedly land dispute in between the parties and a title suit was filed from the side of the petitioner in which the petitioner's side had never appeared despite paper publication. By way of referring to the F.I.R., learned counsel for the petitioner has tried to pursuade the court that it was a case of false
Patna High Court Cr.Misc. No.748 of 2016 (3) dt.15-02-2016 2/2 implication whereas in this case earlier case diary was called for and in paragraph no. 3 of the case diary place of occurrence was examined by the investigating officer and the I.O. had found burnt articles at the place of occurrence. In view of the accusation in the F.I.R. as well as in view of the materials in the case diary, I do not find any ground for extending the privilege of anticipatory bail.
The petition stands dismissed.
